Government considers self-regulatory mechanism for online gambling companies

The government has proposed a self-regulatory mechanism, mandatory verification of players and Indian physical address for online gambling companies, according to the draft rules for online gambling released on Monday. Online gambling companies will fall under the new IT rules enacted in 2021 for social media platforms.

“The draft amendments aim to address the identified needs while allowing for the growth of the online gambling industry in a responsible manner,” the statement reads.

The draft amendments provide that an online gambling intermediary shall comply with the due diligence required by the Rules, “including reasonable efforts to induce its users not to host, display, upload, publish, transmit or transmit any online game.” share that is inconsistent with Indian law, including any laws relating to gambling or betting”.

The draft rule imposes additional due diligence obligations on companies by placing a registration mark on all online games registered by a self-regulatory body and informing their users of their policies regarding deposit payout or refund, the manner of winning determination and distribution, fees and others fees to be paid and KYC procedures for the registration of the user account.

“Self-regulatory bodies are registered with the Ministry (Ministry of Electronics and Information Technology) and can register online games of such online gambling intermediaries who are its members and meet certain criteria. Such bodies will also resolve grievances through a grievance mechanism,” the ad said.

The Department of Electronics and IT has requested public comments on the draft rules by Jan. 17.
