Mr. Montante has established a distinguished career in the legal field, serving as a United States appellate immigration judge since 2020. With more than 35 years of experience, he has made significant contributions to the judiciary in presiding over thousands of court proceedings including those who were seeking political asylum in the United States, relief under the United Nations Convention Against Torture or where being deported and removed from the United States for committing serious criminal offenses. His experience and dedication have been recognized through appointments by two U.S. attorney generals and presidents underscoring his impact on the legal landscape.

Prior to his current role, Mr. Montante served as an assistant chief judge on the United States Immigration Court from 2019 to 2020. He began his tenure with the U.S. Department of Justice when he was appointed by former Attorney General Richard Thornburgh in 1990 as a U.S. Immigration Court judge and held this position until 2019, during which time he presided over cases in Miami and Orlando, Florida as well as in Buffalo, New York. During this time he was also appointed by two U. S. Presidents as a Member of the President’s Commission on White House Fellowships, first from 2001 until 2008 and again from 2018 until 2021. He also served as Chairman of the Federal Executive Board in Western New York in 2001 concurrently with his other roles.

Before his federal appointments, Judge Montante practiced law extensively in Florida from 1975 to 1990, where he focused on state and federal cases, at both the trial and appellate level including the U.S. Supreme Court. Concurrently, he represented numerous cities in South Florida, was appointed as a special assistant Florida attorney general, served as the chief municipal court judge in Margate, Florida and was certified by the Chief Justice of the Florida Supreme Court as a circuit court mediator. The Governor of Florida also appointed him to a four year term on the Judicial Nominating Commission in the 17th Judicial Circuit of Florida where he served as its Chairman from 1975 to 1979.

Mr. Montante early in his career includes his appointment as an assistant state attorney in the 17th Judicial circuit of Florida from 1971 to 1975 where he served first as a felony division prosecutor then as Chief of the Consumer Fraud Division and Chief of White Collar Crimes prosecutions.

In addition to his judicial roles, Mr. Montante was an adjunct professor (instructor) in the 1970’s and 80’s, including Florida Atlantic University, The College of Boca Raton (now Lynn University), Nova University (now Nova Southeastern University) and Broward College.

Serving as a foundation for his professional career, Mr. Montante completed a Doctor of Jurisprudence from Samford University College of Law in 1971, a Master of Education from Florida Atlantic University in 1967 and a Bachelor of Business Administration from Drake College in 1966. He furthered his expertise as a (former) member of the American Judges Association, National District Attorney’s Association as well s the Judicial Division of the American Bar association.

Mr. Montante’s contributions extended beyond his professional roles through publications like “Florida Consumer Fraud Laws: A Compilation” and “Organized Crime Desk Book for Florida Prosecutors.”

He has also been recognized with accolades such as the Distinguished Alumni and Hall of Fame Award from Florida Atlantic University and a Commendation from the Fort Lauderdale Police Department in 1974.

Since his youth, Mr. Montante’s aspiration to become a judge was influenced by his family members, who were accomplished lawyers and judges themselves. This familial inspiration has driven him throughout his career, leading to his esteemed position within the judiciary today.
